The agreement that governs your use of Pocket Social.

1. Acceptance of these terms
These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "your") and the operator of Pocket Social ("Pocket Social", "we", "us", or "our"), which provides the Pocket Social application and website at pocketsocial.net (the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms. If you do not agree, do not use the Service.
2. Description of the Service
Pocket Social is a software-as-a-service platform that helps small service businesses create, review, approve, schedule, and publish social media content with the assistance of artificial intelligence. The Service can connect to third-party social media platforms — including Meta's Facebook and Instagram — so that content you approve can be published and managed on your own accounts. We may add, change, or discontinue features of the Service at any time.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use the Service. The Service is intended for business use. By using the Service, you represent that you meet these requirements.
4. Accounts & registration
To use most features, you must create an account and provide accurate, current information. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You agree to notify us promptly at support@pocketsocial.net of any unauthorized use or security breach. We are not liable for losses arising from your failure to protect your credentials.
When you connect a Facebook Page or Instagram account, you authorize Pocket Social to access and act on those accounts through Meta's official APIs, in accordance with the permissions you grant and our Privacy Policy. You agree that:
You are solely responsible for the content you publish and for ensuring it complies with the rules of each platform;
You have all rights and permissions necessary to connect the accounts and to publish the content you submit;
You may disconnect your accounts at any time, which revokes our access; and
Meta may change, limit, or discontinue its APIs at any time, which may affect the Service, and we are not responsible for such changes.
6. AI-generated content
The Service uses third-party artificial intelligence providers for both text and image generation to produce content based on the prompts and inputs you provide. You understand and agree that:
AI-generated output may be inaccurate, incomplete, or unsuitable, and may resemble content generated for other users;
You are responsible for reviewing, editing, and approving all content before it is published;
You must ensure that AI-generated content you publish is lawful, accurate, non-infringing, and appropriate for your audience and the target platform; and
We make no warranty regarding the originality, accuracy, or fitness of AI-generated output.
7. Your content & license
You retain ownership of the content, prompts, images, and materials you create, upload, or manage through the Service ("Your Content"). You grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, and display Your Content solely as necessary to operate and provide the Service to you — including generating, holding for review, scheduling, and publishing it to the platforms you designate, and transmitting it to the service providers described in our Privacy Policy. You represent that you own or have the necessary rights to Your Content and that it does not violate any law or third-party right.
8. Acceptable use
You agree not to use the Service to:
Violate any law, regulation, or the terms or policies of any connected platform;
Publish content that is unlawful, infringing, defamatory, deceptive, harassing, hateful, or that constitutes spam;
Impersonate any person or misrepresent your affiliation with a person or entity;
Infringe the intellectual property, privacy, or other rights of others;
Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its systems, or other users' accounts;
Reverse engineer, scrape, or copy the Service except as permitted by law; or
Use the Service to build a competing product or in any way not authorized by these Terms.
We may suspend or terminate accounts that violate this section.
9. Intellectual property
The Service — including its software, design, branding, logos, and all related intellectual property — is owned by us and our licensors, and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in and to the Service. You may not use our name, logos, or trademarks without our prior written permission.
10. Subscriptions & fees
Certain features of the Service may require a paid subscription. Where fees apply, they will be described at the point of purchase. Unless stated otherwise, fees are billed in advance, are non-refundable except as required by law, and subscriptions renew automatically until cancelled. We may change our pricing on prospective notice. You are responsible for any taxes associated with your use of the Service.
11. Third-party services
The Service integrates with and depends on third-party services, including Meta (Facebook and Instagram) and our cloud hosting, storage, and AI content-generation providers. Your use of those services through Pocket Social may be subject to their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services, and their acts or omissions are beyond our control.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that content will be published on time or without loss. You use the Service at your own risk.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKET SOCIAL AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Pocket Social and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
15. Termination
You may stop using the Service and delete your account at any time (see the Data deletion section of our Privacy Policy). We may suspend or terminate your access to the Service at any time if you breach these Terms, if required for legal or security reasons, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
16. Governing law & disputes
These Terms are governed by the applicable laws of the jurisdiction in which the Service is operated, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the courts of competent jurisdiction where the Service is operated, and you consent to the personal jurisdiction of those courts.
17. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Changes take effect when posted. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
